Medical Power of Attorney Form
A Medical Power of Attorney form is a paper document signed and filled up by an adult or a principal, appointing a person or an agent to make actions on his health care and make decisions in his behalf when it comes to medical matter if the time comes that the principal will not be able to make decisions. Once the Medical Power of Attorney form is signed, processed and delivered, it immediately takes effect. There is no specific date or duration on its affectivity unless the document specifies a specific date of termination, it is canceled and the principal becomes capable.
An attorney or agent may be able to make medical decisions on behalf of the principal only if the attending physician of the principal confirms and certifies in terms of writing or paper document the incompetence of the principal. A certification must be filed by the doctor or physician in the medical record of the principal. However, whatever decision or treatments that the agent suggests will not be performed if in case the principal objects.
Should the principal be incompetent or not, once he objects, he will be followed. There are wide ranges of consent that are given to an agent; however, these are the things he cannot allow: mental institution commitment, treatment for convulsion, psychosurgery, desertion of comfort care and abortion. This document will not be legal unless fully understand and read by the principal before any signing. A disclosure statement is being signed as confirmation of agreement.
