Probate Court: Heirs Can Lose Their Inheritance
Probate court verifies the Last Will and Testament of a deceased person. Probate court ensures inheritance is distributed per the decedent’s final wishes after all creditors have been paid. Having inheritance go through the probate court process is not good for beneficiaries.
Probate court processing can take six to nine months in the best case scenario. If heirs are in disagreement over family heirlooms or if the deceased died without a Will (intestate), it can take years to settle. The court’s fees are not paid through government dollars. The decedent’s assets pay for all fees, including lawyers who charge expensive hourly rates. A drawn out court proceeding is expensive and can bankrupt an estate leaving the heirs with no money for their inheritance.
If an estate administrator is not named in the Will, the probate court will appoint one, usually picking a family member. The estate administrator has numerous responsibilities including providing an accounting of all expenses charged to the estate while being probated. The estate administrator’s other duties are to list all debts owed by the decedent at the time of death, contact any creditors, provide a detailed inventory and appraisals of assets. Lengthy proceedings are a huge burden for loved ones acting as estate administrator.
One way to expedite the probate court process is to sell probated properties to estate investors. In most states if heirs are in agreement, the estate administrator can approve sales themselves. Selling to an estate investor helps heirs get more money from their loved one’s assets. Also, beneficiaries don’t have to worry about sorting through and disposing of unwanted personal items such as old paint cans, knick knacks or outdated furniture which can be emotionally and physically draining.
Buying probated property can be tricky. Complex legal procedures can confuse inexperienced estate investors. Probate court judges can intimidate amateur buyers causing them to make mistakes that are time consuming and costly to the estate.
