Pulled Over For DUI ? What to Say Before Talking to DUI Lawyer
If a police officer suspects you of driving under the influence and pulls you over then it can be very scary. Even if you’re innocent it can be stressful, there are a few things that you should do to make sure that you don’t accidentally incriminate yourself. There are lots of things that you can do when you are pulled over just in case you are charged with DUI.
Many people think that it’s a good idea to be polite and volunteer any information that the officers want. However you should never give up any information, the only time you need to talk is to show them your identity and insurance. If the officer asks you any questions then don’t answer them. Never talk about how much you have drunk. Be polite and state that you won’t answer any questions until you speak to your DUI lawyer. This is acceptable and well within your rights. Talking about anything can help to build a case against you.
Don’t do any form of sobriety tests, but when you decline make sure you stay polite. These are not required by law and even if you are sober they will not help you should your case go to court, the only thing they will do is help to build a case against you. The officer does not need to do these tests before they arrest you, if the officer asks you to do these tests then there’s a good chance that they have decided to arrest you already. These tests are just designed to collect evidence against you.
When the officer stops you it’s important that you are polite. The officer will be studying your actions carefully and they could have an impact on your case. You need to make sure you are calm and don’t get agitated. Being polite won’t be enough to get you off the hook, however being aggressive is likely to do nothing but make your case worse. You must be honest to the officer, if you lie then this will damage your credibility and may come back to haunt you. If you do want to answer the questions of the officer then make sure you are honest. But it’s much better to wait until you have spoken to a DUI attorney.
If the officer still believes that you are driving under the influence then you will probably be arrested. In this case then you should probably take a blood or breath test when requested. Unless you do these then there is a good chance that your license will be revoked or suspended. As soon as you possibly can you should contact an experienced DUI attorney. A lawyer will help to build your defense and explain the legal proceedings.
Many people make mistakes when they are pulled over by behaving in a way which will incriminate them. If you are pulled over on the suspicion of a DUI then it’s important that you are polite and don’t do anything to help the police build a case against you. Following this advice may not prevent getting arrested in the first place, but it should make it as easy as possible to fight against your case. A DUI lawyer will make it much easier to fight against the case.
