In our modern society, legal issues arise practically every day. Given this fact, you need to know how to pick an attorney for your situation.

If you live in America, you are going to run into some type of a legal issue that must be addressed. Hopefully, the issue is something minor such as dealing with home purchase, but there will be many situations in which it is wise to retain an attorney. The question for most people, however, is how to pick an attorney from the thousands available? There are a number of important issues to consider when picking an attorney. Two, however, are the most important.

The first thing to focus on is finding an attorney that practices in the area you are having an issue. This may sound obvious, but many people make this mistake. If you have an issue involving problems with the sale of your home, you want to pick an attorney that focuses his or her practice entirely on real estate. Picking a business attorney or general practice attorney is a poor choice because they do not know the ins and outs of the area of law. Each area of law is complex. New case rulings are issued daily, so keeping up on breaking developments requires an attorney to really just focus on one area of law.

The second issue is experience. You want an attorney with plenty of it. Why? An attorney with a lot of experience in a particular field has a reputation. In handling a legal matter, attorneys always evaluate the lawyer on the other side. If you have an experienced attorney, your opponent knows it is going to be a rough case and will be more likely to give you the result you want. This reputation and experience issue also extends to the court room where judges give more experienced lawyers the benefit of the doubt.

When it comes time to picking an attorney, you want to speak with at least three. The initial consultation should always be free. During the consultation, ask the attorney how long they have been practicing, if they have ever had a complaint registered with the bar association [regulates attorney licensing] against them, and if they have ever handled a case such as yours and the result.

On the practical side, ask them who in the office will work on your case. Many people are surprised to learn that the attorney they retain will actually have paralegals, law clerks and associates doing much of the grunt work on legal issues. This leads to problems when a client wants to talk to the senior attorney, but primarily receives communications from the associate [junior attorney] or paralegal. In short, ask the attorney how the case will be handled within the office and make sure you are comfortable with the answer. If you are not, move on.

The issue of how to pick an attorney is a common one. When in doubt, look for expertise, experience and a comfortable communication situation.

If you intend to purchase a manufactured home, you should definitely ask the manufacturer about its compliance with the HUD code; there are many unscrupulous establishments that make the false claims of HUD compliance. If a certificate has not been furnished or if you don’t have a legal document stating that the manufactured has claim that he structure is HUD compliant, you will be able to do very little legally and may have to undertake construction effort to bring it up to compliance from your own pockets. There are several product which are covered under the lemon laws in Texas such as trucks, defective cares, recreational vehicles, motorcycles and even boats, all vehicles or that were purchased with a written warranty including household products such as computers and other consumer durables are covered by the law. If you are dealing with a defective vehicle, you will need to file your claims with the Motor Vehicle Board of the Texas Department of Motor Vehicles. The manufacturer or dealer subsequently gets two more attempts to fix the same problem in the next 12 months or 12,000 miles, so essentially, the manufacturer gets four shots at repairing the vehicle in 2 years or 24,000 miles. However, if the manufacturer cannot rectify the problem in these 4 attempts, the consumer can submit a claim or even move court in the matter if a satisfactory resolution is not reached.

The safety hazard test: It would be difficult to determine which is better the four time test or the safety hazard test if a safety hazard indeed exists; however, you need to understand that a safety hazard is interpreted rather broadly, you can expect the rule to be quite stringent to file a claim in this context. Several problems can be deemed to be safety hazards; for instance, a brake failure or even malfunctioning rear lights. Even safety belts that work improperly can be considered to be a safety hazard. However, the Motor Vehicle Board of the Texas Department of Motor Vehicles does offer certain allowance so that the manufacturer can get ample of opportunity to correct the issues before lemon laws in Texas are applied to the matter. However, since a safety hazard can jeopardize the life of the driver and other people on the road, the manufacturer only gets 2 attempts to fix the issue, o the manufacturer can try and rectify the issue once in the first 12 months or 12,000 miles and one more attempt to do the same in the next 12 months or 12,000 miles. If after both opportunities the manufacturer still cannot yield satisfactory results; then the consumer can submit a claim,

The 30 day test:
According to this test, the dealer or manufacturer can only keep the vehicle for up to 30 days in order to rectify a problem; however, these days don?t have to be consecutive. But only 30 days are allowed in the first 24 months or 24,000 miles.

This is the best way to ensure that any issues that may eventually arise are covered by the manufacturer and you can approach the court to seek help in the matter.

The term reasonable number of attempts is defined the law based on the defect. For instance, in case of serious mechanical issues like consistent brake failure which may lead to grievous injury or even the death of the consumer, two or three attempts to repair the problem will be considered sufficient while in case of minor faults which may not turn into a hazard, four attempts would be deemed as reasonable.

The Advantages of Chapter 11 Bankruptcy

Chapter 11 bankruptcy was originally designed for businesses but individuals may also file under this chapter. Those individuals who exceed the debt limits of chapter 13 bankruptcy are required to file under chapter 11. The current debt limits for chapter 13 is $1,010,650 for secured debts and $336,900 for unsecured debts. The debt limits appear to be low for those individuals who own more than one property whose values have dropped significantly.

There are many advantages of being in chapter 11 as opposed to chapter 13. When individuals file for chapter 7 or chapter 13 bankruptcy, they are subjected to a means test. Those debtors who are above the median income limit for their household size cannot file under chapter 7 and if they file under chapter 13, they are required to make payments in a five year plan. However, the means test does not apply to the individual debtors in chapter 11 cases so they may propose repayment plans that are less than five years and therefore, they will end up paying less of their disposable income to unsecured creditors.

In chapter 11, the debtors can modify their secured debts such as car loans and mortgages. There is a time restriction in chapter 13 cases where the debtor must have financed the vehicle more than two and half years ago before the loan can be reduced to the value of the car. However, in chapter 11 cases there is no time restriction so if you purchased a vehicle a year ago and if the loan is more than the value of the car, you are only required to pay back what the car is worth and not the original balance. In both chapter 11 and 13 cases, the debtors can modify the mortgages on their rental properties. For example, if the value of the property has dropped below the outstanding mortgage, you are only required to pay back the amount based on the current value of the property. The only caveat is that individual debtors are not allowed to modify their primary residence.

Once the values on the secured properties have been established, the debtor will then propose a plan of repayment of the secured and unsecured debts. The plan duration can be controlled by the debtor such as a three year or longer plan. The debtor must submit the plan to the creditors for a vote and if the case is to proceed forward, the debtor must receive at least one vote from the creditors. The remaining creditors that object to the plan can be forced to accept the plan by the court which is called a ?cram down.? The advantage of chapter 11 bankruptcy is that the debtor has control over the content of the plan and may propose terms that are to his benefit. However, the advantage of chapter 13 bankruptcy is that you don?t need to solicit the votes of the creditors but you are subjected to a three or five years plan based on your income. As you can see, it is a complex strategy in choosing the best chapter for bankruptcy based on an individuals circumstances.

New FMCSA Rule Pleasing to California Bus Accident Lawyers

California truck accident lawyers have long been concerned about the truck and bus safety issues regarding poor safety standards and dismal compliance rates of newly registered trucking and bus companies. Now, federal agencies seem to be increasing their efforts to oversee these new companies so that accidents involving these new carriers might be reduced. California bus accident lawyers are please by these changes, which started on December 15th. On this date, the FMCSA started enforcing a rule that requires these new companies to comply strictly to strong safety requirements or suffer the consequences, which means potentially being taken off the roads.

In order to pass new safety audits, truck and bus companies must meet higher compliance standards under the New Entrant Safety Assurance Process rule. This essentially means that any deficiency found has to be rectified prior to the company applying for permanent registration. If even one of the 16 federal regulations is violated, new companies will automatically fail their safety audits. The 16 safety regulations, or “16 deadly sins” as they are also known, are as follows:

1. Failure to test drivers for drugs and alcohol

2. Allowing a truck or bus driver who has been found with a blood alcohol level of .04 percent or more to perform key functions.

3. Using drivers even though they refused to test for drugs and alcohol

4. Using drivers even though they have tested positive for using drugs

5. Neglecting to put a random alcohol or drug testing program in to place

6. Allowing drivers who are unqualified to drive (not having a valid commercial drivers license)

7. Allowing a driver whose license has been canceled or revoked to drive a truck or bus

8. Allowing a disqualified driver to operate a truck or bus

9. Allowing drivers without the necessary minimum level of financial responsibility to operate a passenger motor carrier

10. Allowing drivers to operate a motor vehicle although they do not have the necessary minimum financial responsibility coverage

11. Allowing a disqualified driver to drive

12. Allowing a driver who is physically unfit to drive

13. Neglect when it comes to getting drivers to record their duty status

14. Operating a bus or truck that is scheduled for repair and unfit for service to be used before it has been repaired

15. Operating a bus or truck without repairing defects reported and listed by the previous driver

16. Operating a bus or truck without performing the periodic inspections

Truck and bus companies that violate even one of these regulations may fail their safety audit according to the new rules. A company’s registration may be revoked if the safety audit is not passed, unless the company makes an effort to correct the problems within a certain time period. If a truck or bus is subject to a roadside inspection and safety violations are discovered, it may lead to a safety audit or compliance review, which may mean fines. The motor carrier could even face being put out of service.

What is a securities lawyer in the first place? A securities lawyer is a person licensed to practice the rules of conduct in the world of bonds, stocks, and similar instruments and mechanisms from a legal perspective.

They mainly in three branches: regulatory work, transactional work, and litigation. These three branches give these lawyers the responsibility to stay informed and up-to-date on the legal rulings and laws related to securities, work with clients, and to serve and act as a resource.

So, under what circumstances are divorce attorneys needed? The only time you will need a divorce attorney is when you are getting a divorce. You and your partner (ex-partner) will need to find your own separate lawyers, as sharing one is not an option due to there being a clear conflict of interest. They will work with you to help you get the best possible result based on your circumstances and will act as a go-between, meaning that direct communication between you and your ex will be at a minimum.

You might think that you can save yourself some money by not using a divorce lawyer by simply coming to an amicable agreement with your ex. However, this is not recommended because divorce proceeding are complex and, even if things start off on a friendly basis, good will can quickly be worn down.

It is important that all terms of the agreement are both valid and legally binding and only a lawyer can ensure that this is the case. As well as making sure that your ex sticks to what they have agreed to do, you will also want to make sure that you fully understand the terms of the agreement that you have assented to, because once you sign it you will be bound by it. Simply saying at a later date that you misunderstood a term, or was mislead on it, is not a valid defense for not adhering to it.

Another important reason for enlisting the help of a divorce attorney is that divorce laws vary from state to state. Just because you saw something on TV, or read somewhere, something that you think will be beneficial to you in the proceedings, it does not necessarily mean that it is enforceable in your particular state. Some states require a formal separation for a certain length of time prior to granting a divorce, while others require an informal separation before granting divorce. There are also residency requirements to consider as well. Divorce lawyers will be fully aware of these varying rules and regulations and will be able to advise you accordingly.

How can you find divorce attorneys? Finding divorce attorneys is probably easier than finding other kinds of attorneys for the simple fact that they are so commonly needed. Someone you know has probably been through a divorce themselves and will as such be able to give you some recommendations or referrals. If they were not completely satisfied with their experience, or if you do not think you should use that lawyer, consider using online directories or your local telephone directory to help find a divorce attorney that can help you.
