An expert witness testimony can play an absolutely vital role in determining how a judge or juror might see a case. When a juror hears about what can cause an certain medical injury from an experienced physician, they will listen and believe them more than the lawyer or untrained individual. It is the lawyers job to prove that someone is guilty or not. A certified witness is one of the best ways that a lawyer has to do this.

Not just anyone can call them self an expert witness. This is why the Judaical system have a certain standard they go by for witnesses to be board certified witnesses. There a several programs, associations, and societies that offer various classes and programs that explain what is required from an expert witness and the qualification that must be met. Also key legal concepts and the role of the witness are outlined in this training.

Once a person have met all the necessary requirements to be board certified whether through certification, experience, or education they can then be considered a board certified expert witness.

In addition to providing the state of care of medical and health cases, a physician expert witness may also be called to determine the mental state of a defendant in certain cases. Often time someone can get acquitted due to the their mental state at the moment of a crime. Also if a person is mentally capable of being responsible for their action.

A trained physician or doctor will be more than qualified to answer any of these question and more. The importance of a key witness that not only has education but experience on a certain topic is priceless. This is especially true in the case of someones freedom.

With out the thoughts and viewpoints of expert witnesses jurors would not have the necessary knowledge of a particular subject to make the fairest and most just verdict possible. For this reason it is important that a person that has the responsibility of relaying this knowledge to the jurors is well educated in the field in which they are talking about.

Now board certified for physician expert witnesses have a certain obligation to themselves, the jurors, and the defendant to be honest when they are testifying on the stand. Knowing that a witness testimony can determine a person freedom is a great responsibility and treated as such. A person is assumed innocent into proven guilty, and person has to be proven guilty beyond a reasonable doubt. So as a expert witness you may be the only difference in doubt and no doubt.

In Sanford v. Commonwealth of Virginia, Civil Action No. 3-08 CV835, the plaintiff’s decedent had been hospitalized for the removal of a kidney. The decedent suffered from a rare genetic disorder which caused cerebellar damage and severe loss of muscular coordination. Two days after the surgery, the patient was found by his brother in the hallway outside his room delirious and hallucinating. Although the police were summoned to help restrain the patient, his brother was successful in convincing him to return to his bed. The next day, a different family member found the patient delirious and hallucinating on the floor of his hospital room. His brother requested a psychiatric consult because the patient did not have a prior history of delirium or hallucinations. The next day, the patient again became delirious, allegedly as a consequence of medications he had been prescribed by his physicians. Nurses summoned the police and a security guard to the scene. They arrived shortly thereafter, and one officer and the security guard allegedly seized the patient, wrestled him to the ground, handcuffed him behind his back and held him in a prone position. While he was restrained, a nurse injected him with Haldol, a sedative. After approximately 30 minutes, the police officers and nursing staff turned the patient over and discovered he was dead. The patient’s family sued the police officers and the security guard alleging that they had used excessive force and violated his constitutional rights under the fourth and fourteenth amendments. Three nurses employed by the hospital were also sued based on allegations that they had violated the patient’s constitutional rights. Two of the nurses were charged with gross negligence in the application of restraints and failure to monitor the patient appropriately while he was restrained. Several other counts were asserted against the nurses, including battery, false imprisonment, and intentional infliction of emotional distress. Four physicians who were employed at the hospital and involved in the patient’s care at various times were also sued for medical malpractice. The allegations of malpractice included improper prescription of medications and failure to diagnose and treat the patient’s delirium.

The same defense attorney was retained to represent each of the defendants employed by the hospital, including all four physicians, three staff nurses, the hospital’s Chief Nursing Officer (who was accused of failing to train the nurses properly) and the security guard. At the outset of the litigation, a single attorney employed by the Virginia Attorney General’s office represented each of the police officers involved in the case. However, as the case progressed that attorney withdrew from the representation in favor of a single attorney in private practice.

After the conclusion of substantial discovery, including the designations of expert witnesses and over 50 depositions, the plaintiff moved to disqualify the attorney for the medical defendants and the attorney for the police officers based on a conflict of interest. In a 38 page opinion published on December 2, 2009, Senior United States District Judge Robert E. Payne granted the motion.

The motion was based on Virginia State Bar Rule of Professional Conduct 1.7 which provides in relevant part that “a lawyer shall not represent a client if the representation involves a concurrent conflict of interest.” That rule goes on to provide that a concurrent conflict of interest exists when “there is significant risk that the representation of one or more clients will be materially limited by the lawyers’ responsibilities to another client, a former client, or a third person, or by personal interest of the lawyer.” Judge Payne noted in his opinion that the Court had raised the possibility of a conflict of interest at both the initial pretrial conference in March of 2009 and at a status conference in September of 2009. Counsel for both sets of defendants represented to the court that after those conferences, they met with their clients and obtained their consent to the joint representation. However, the plaintiff contended that two notes to the conflict of interest rule prohibited the joint representation.

The first note provides that consent to joint representation cannot be given “when a disinterested lawyer would conclude that the client should not agree to the representation under the circumstances.” The second note identifies situations which may result in an impermissible conflict, including “substantial discrepancy in the parties’ testimony, incompatibility in positions in relation to an opposing party or the fact that there are substantially different possibilities of settlement.”

With respect to the medical defendants, the discrepancies in testimony and incompatible positions included:

-Defense expert opinion which supported the conclusion that one of the physicians misdiagnosed the patient.

-The fact that one physician made a note that Haldol should be avoided for the patient. However, he did not put that note in the hospital’s electronic records system, and another physician prescribed and two nurses administered the drug.

-There was a conflict between the testimony of the CNO and one of the nurses about the extent of the training provided regarding patient restraint.

-The defense of one of the physicians was based on the fact that he was on vacation at the time of the patient’s death and had turned all responsibility for his care over to a different physician represented by the same attorney.

-The physician who prescribed the Haldol while the patient was restrained did so based on information provided by one of the nurses over the telephone; however, there was significant evidence that the information which the nurse provided was inaccurate.

After discussing several cases interpreting the rules of professional conduct with regard to conflicts, Judge Payne concluded that “the conflicts that are presented here are real conflicts. They exist now and they have existed throughout the course of the case.” He further concluded that the conflicts “raise the serious prospect that the trial could fall into disarray.” Judge Payne concluded that while counsel for the medical defendants had staked out defensive positions that they thought were best for the defense of the case considered as a whole, counsel had not considered how the assertion of those positions would affect the ability of each defendant to mount his or her best possible defense as an individual. He noted that “each defendant is entitled to use the record to exonerate himself or herself even if to do so inculpates another defendant in the same category of defendants.” Finally, Judge Payne found the consent to joint representation purportedly obtained from each defendant to be ineffective as a matter of law because neither the attorney for the police defendants nor the attorney for the medical defendants “reasonably could have believed that, under the circumstances of this case, they could represent all of the defendants whom they undertook to represent.”

Even our insurance premiums may be affected. When someone files a false claim and insurance companies pay out on it then they have to get that money back. They don’t get it from the person who files the claim but from everyone who has insurance with them. No matter who files that claim it is all policy holders who pay in the end.

Government run programs are often the target of fraud. These programs are paid for by each and every one of us through tax dollars. When someone commits fraud it not only costs us but it could mean others are not getting the care they need. It may also mean the programs won’t be around when we need them our selves.

Because of fraud in the health care system, some procedures and medications may not be available to those who need them most. Some of these could be life saving but instead people suffer and possibly die because of those who take advantage of the system or abuse narcotics. No person should have to live in pain because of other peoples addictions.

Health care providers are guilty as well. Every time a bill is padded or they charge for a procedure that wasn’t done this is fraud. Some doctors and hospitals have even invented ghost patients to get more money. Fraud of this type could even be as simple as performing procedures that are not medically necessary.

While you may not be able to prove weather or not a procedure was necessary you can prove weather or not it was preformed. What one doctor considers legitimate another may say was unnecessary. This is a gray area and not all doctors will agree on what is best for a patient. More often than not this is left at the doctor’s discretion.

Another form of medical care fraud is medical identity theft. This occurs when a person uses another’s identity to gains access though their medical coverage or you may find huge medical bills in your name that aren’t yours. They can also use your name to get narcotics due to an addiction. This can affect your medical records and be very dangerous.

The simple fact is that fraud affects each and every one of us. Imagine not being able to get medical coverage for your child because of other peoples fraudulent activities. Worse, imagine your child being given the wrong medication because of medical identity theft.

You can help prevent fraud simply by knowing what is in your medical files. Help insure that all people who need medical coverage can have access to it. Report any suspected fraud to proper authorities.

The best use of a medical malpractice expert is to enlist an expert one who specializes in the area of the medical injury. For instance, if one sustains a serious brain injury as the result of a car accident, hiring a brain injury specialist to provide testimony about the damages one incurred will strengthen the case. Another example is if someone slipped on a wet floor in a mall and injured their spine. An orthopedic surgeon would be an effective medical expert witness for a personal injury claim. If you are the one being sued, a medical expert witness can be used to discredit the extent of the claimed injuries which is very important if you are being sued for a large amount of money.

A medical expert witness should be able to separate facts of a case from evidence that is subject to disagreement; or, in other words, medical evidence that can be disputed. To be effective, the expert must have knowledge of the science and medicine associated with the injury in order to either prove or disprove a claim. As well, he or she should be able to provide corroborating evidence to support their testimony such as research or studies where other experts in their field agree with the expert?s conclusions about the facts of the case that has been presented to the court. When supported and verifiable testimony is presented by an expert, it makes it easier for a judge or jury to reach an informed conclusion.

A medical expert witness will have an understanding of the technology used to analyze evidence such lab tests, X-Rays, and other diagnostic tools. In recent years, the fast-paced development of innovative forensic technology has led to an increase demand for medical expert witnesses who can explain the tests and the significance of the results.

The strength of a case can be improved when you have the testimony of an expert that is respected by their peers and if their medical opinions are generally accepted by the medical community. If their opinions and conclusions are largely challenged by the medical community, that will lower the expert?s credibility. As well, a case will be strengthened if the medical expert can talk in layman terms that are understood by a judge and jury. An expert that uses terms that are too technical will often baffle a jury and judge which can damage a case.

Most prosecutors and law firms will have a list of their own medical expert witnesses. When selecting and using a medical expert, you have to make sure that you make the most of the witness in order to strengthen your case. The signs that are classically associated with pregnancy induced hypertension, or pre-eclampsia, are (1) high blood pressure and (2) protein in the urine. Other symptoms may include (1) scotoma or visual issues, (2) reduced urine output, (3) nausea, (4) vomiting, (5) abdominal pain, or (5) headache. The presentations by the patients to the doctors vary, and some women may only have a very few of these symptoms. Atypical presentations may be more difficult to diagnose and can require an experienced physician?s review. Once diagnosed, the treatment for pre-eclampsia may include delivery of the baby and/or medication with magnesium sulfate.

While treatment for this condition reduces the risk of an adverse outcome, if left untreated, pre-eclampsia can result in the mother having a seizure, a condition commonly referred to as eclampsia. Pre-eclampsia can also place the mother at risk for stroke, impaired kidney or liver function, fluid on the lungs and even death. Because of its effect on the placenta and its blood flow, pre-eclampsia may impact the health of the baby as well as the mother. It can result in a premature delivery, cause a lack of oxygen to the baby?s brain, or result in the infant?s death.

Proper pre-natal care can prevent this condition from having devastating consequences. Pre-natal visits should include a blood pressure check and a urine test to see if there is evidence of protein. If pre-eclampsia develops late in the pregnancy the baby can be delivered thereby controlling the pregnancy induced high blood pressure. If pre-eclampsia develops early in the pregnancy, the mother may be placed on bed rest while efforts are made to reduce the mother?s blood pressure through other means.

While pre-eclampsia will often develop gradually it can, in some cases, appear suddenly. While usually appearing during the third trimester of the pregnancy, it can develop earlier in the pregnancy and in some cases in the hours after delivery.

The failure to appreciate the signs of this condition in the patient, and to act to protect the mother and baby from its potentially devastating effects may constitute negligent care/medical malpractice. Physicians, residents, obstetrical nursing staff, and all others who provide care to the pregnant mother should be vigilant in monitoring for both the subtle and not so subtle signs of this disease and be prepared to take swift action.

If you or someone close to you has suffered an eclamptic seizure or had a child who was born with problems that may be related to pre-eclampsia, you may want to have the medical records of your care reviewed by an attorney who specializes in medical negligence and/or birth injury cases. Typically experts from several medical specialties will be involved to assess the circumstances of the birth. An obstetrician/gynecologist will need to review the records to determine if the obstetrical care was substandard and provide an opinion on this issue. Nursing experts may need to review the records to evaluate whether or not the nurses, who have an independent duty to the patient separate from that of the doctor, complied with nursing standards of care.

A pediatric neurologist and a neuroradiologist will likely be retained to evaluate whether or not negligence caused the baby?s condition to occur. There must be proof of negligence or substandard care and proof that the negligent care caused your baby?s harm. Without proof of a cause and effect relationship between some conduct or misconduct by medical personnel and the condition of the baby, a legal case cannot be proved.

RULING OUT NON-NEGLIGENCE CAUSES

It will be important for the experts to rule out other non-negligent causes for your baby?s injury. Since it is your burden to prove that it was substandard care that caused your child?s problems, the non-negligent causes for his or her condition will have to be discounted and ruled out in order to properly establish the case.

STATUTE OF LIMITATIONS

Each state has different laws which govern how much time you have to bring a claim on behalf of your injured child. You need to check with a local lawyer to find out what the time frame is for pursuing a claim on behalf of a minor in your state. Parents typically have much shorter periods of time to pursue any claims they may have in connection with the birth of an injured child. In some states, minors have until two years past their age of majority to bring a claim creating a long window for investigating and pursuing a case on behalf of your minor child.

DAMAGES

The damages to your child can be catastrophic, impacting upon all aspects of his/her life. Life care planners will serve to evaluate your child?s long term needs and what the cost of that care will be over your child?s lifetime as part of an assessment of what the damages are that have resulted from the negligence. The non-economic damages of disability, physical pain and suffering, and loss of life?s pleasures are items that will need to be demonstrated through expert testimony, and are typically left to be quantified by a jury if negligence is proved.

CONCLUSION

It is never easy to prove that a doctor?s medical malpractice was the cause of a birth defect or injury. In addition, the process that medical malpractice attorneys use to evaluate these types of negligence cases can be time-consuming. However, without a thorough analysis of the records by an experienced birth injury lawyer, malpractice may be overlooked. That is why attorneys who handle medical negligence cases work with medical experts to verify whether or not the claim can be proved.

While an evaluation does not always determine that the doctor or hospital or other medical provided negligent, the conclusions reached may provide some answers why the injury occurred.

Can they accurately scrutinize and assess injury information from medical records, especially if it exceeds what a patient has discussed?

In contrast, good legal nurse consultants possess impressive curriculum vitaes with extensive clinical experience and years of preparing materials for litigation. They?re comfortable with legal process. They?re intimately familiar with medical records; they know how and where to find information, what they contain and how they?re organized. They?ve cared for many, many patients, from injury onward through the medical process. Their expertise can be significant in cases from start to finish.

For plaintiff?s counsel, it?s crucial from the outset and throughout a case to get a full grasp of the extent and legal value of a patient-client?s injury or harm. The party suing, claiming an injury, is the plaintiff. This is a tort offense. Tor is a French term meaning wrong. The defendant is the person being sued, accused of the tort or wrongful act. The lawyer will first ask the witness his or her name. He will then ask the witness to tell the jury his or her background and why he or she is qualified as an expert witness.

Establishing a foundation in court means allowing the expert witness on the stand to detail his or her credentials, reputation, and background. The same is true for the personal injury case. In that trial both sides will testify as to the injury sustained by the plaintiff and how the injury will affect the rest of the plaintiff’s life.

The plaintiff will present and expert testifying that the injuries are very severe and the long term results are very dire. The defendant on the other hand will have a medical expert testify that the injuries are not as severe and the long term results not as dire as the plaintiff’s witness claims.
